Welcome to Litter Troopers™! These Terms of Service ("Terms") govern your use of the Litter Troopers web and mobile applications (the "Service"). Please read them carefully. By accessing or using our Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service in any way, you affirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you may not use the Service.
2. Description of Service
Litter Troopers is a platform designed to empower individuals and communities to track and document their cleanup efforts. The Service allows users to map their cleanup routes, geotag photos of collected litter ("Garbage"), view community-wide efforts, and organize cleanup meetups.
3. Age Requirement
You must be 18 years of age or older to use this Service. This includes creating an account or using the application as a guest. By using this Service, you represent and warrant that you are at least 18 years old.
4. User Conduct and Content
You are solely responsible for your conduct and any data, text, information, and photographs that you submit to the Service. You agree that you will not:
- Upload any photograph containing identifiable people, personal information, or private property without consent. The focus of all uploaded content must be exclusively on Garbage and the cleanup area.
- Trespass: You agree not to enter private property without explicit permission from the property owner.
- Post any content that is illegal, defamatory, obscene, or promotes hate or violence.
- Use the Service for any illegal or unauthorized purpose. You agree to comply with all local laws regarding online conduct and acceptable content.
5. Analytics and User Feedback (Beta Phase)
To improve the user experience and identify bugs during our initial beta testing phase, we use Microsoft Clarity. Clarity is an analytics service that helps us understand how users interact with our website.
- What it does: Clarity captures anonymized session recordings and heatmaps to help us find and fix bugs and improve the overall design.
- What it does NOT do: All data is anonymized. We do not use it to collect personal information. Keystrokes in sensitive fields like passwords are not recorded.
- Our Commitment: The use of Microsoft Clarity is for the initial testing phase only. This specific tool will be removed in future stable releases.
6. User-Organized Meetups & Liability Waiver
LITTER TROOPERS PROVIDES TOOLS TO HELP USERS ORGANIZE PUBLIC CLEANUP EVENTS ("MEETUPS"). YOU ACKNOWLEDGE THAT THESE MEETUPS ARE ORGANIZED AND ATTENDED BY INDEPENDENT USERS. LITTER TROOPERS (P1 CREATIONS LLC) IS NOT A PARTY TO, AND IS NOT RESPONSIBLE FOR, ANY INTERACTIONS, INJURIES, ACCIDENTS, OR INCIDENTS THAT OCCUR AT THESE EVENTS. FOR YOUR SAFETY, ALWAYS MEET IN PUBLIC PLACES, WEAR PROTECTIVE GEAR, AND EXERCISE CAUTION.
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
P1 Creations LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the Service or your participation in any user-organized Meetup.
9. Data Rights and Deletion
We respect your privacy. You have the right to access, correct, or request the deletion of your personal data. You may request the permanent deletion of your account and all associated geotagged data by contacting us at the email provided below. We will process verifiable requests within 45 days.
10. Mandatory Arbitration and Class Action Waiver
Arbitration: You and P1 Creations LLC agree that any dispute arising out of or relating to these Terms shall be settled by binding individual arbitration in Chicago, Illinois, administered by the American Arbitration Association (AAA).
Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
11. Global Use and Local Compliance
While the Litter Troopers platform is accessible worldwide, P1 Creations LLC makes no representation that the Service is legally permissible, appropriate, or safe to use in all geographic locations. You are entirely responsible for knowing and obeying all local laws in your specific jurisdiction while performing real-world cleanups. This includes, but is not limited to, laws regarding trespassing on private property, public photography, hazardous waste disposal, and municipal recycling regulations. P1 Creations LLC assumes no liability for citations, fines, or legal action brought against you for violating local ordinances while using the app.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.
13. For Users in the European Economic Area (EEA) and UK
If you are a resident of the EEA or the UK, the following additional terms and exceptions apply to you:
- Age Requirement: As an exception to Section 3, you must be at least 16 years old to create an account in the EEA. If you are under 16, you may only use the app with the verifiable consent of a parent or legal guardian.
- User-Generated Content License: When you upload photos of your cleanups, you retain ownership. However, you grant P1 Creations LLC a non-exclusive, royalty-free license to display these photos within the app, on the community map, and for promotional purposes related to Litter Troopers.
- Consumer Rights & Liability: Nothing in these Terms limits your mandatory statutory consumer rights under the laws of your country of residence. Our limitation of liability applies only to the maximum extent permitted by applicable EU law.
- Dispute Resolution & Governing Law: The Mandatory Arbitration clause (Section 10) and Illinois Governing Law clause (Section 11) do not apply to you. These Terms are governed by the laws of your country of residence, and you may bring legal proceedings in your local courts. Alternatively, disputes may be submitted for online resolution to the European Commission Online Dispute Resolution platform.
